Common Accidents in Hialeah
Car Crashes
Congested roads like Okeechobee Road and West 49th Street see frequent rear-end, T-bone and left-turn crashes.
Pedestrian Injuries
People walking to bus stops, stores and the Hialeah Metrorail and Tri-Rail stations are at risk from speeding and distracted drivers.
Slip and Falls
Supermarkets, shopping plazas and apartment complexes must fix hazards and warn visitors.
Where Crashes Happen in Hialeah
Many Hialeah crashes happen on Okeechobee Road (US-27), West 49th Street, the Palmetto Expressway (SR 826), the Gratigny Parkway, East and West 4th Avenue, and the major intersections around Westland Mall and Hialeah Park. Florida Law You Should Know
- Two-year deadline. For most negligence claims arising on or after March 24, 2023, you have two years to file a lawsuit.
- Modified comparative fault. If you are found more than 50% at fault, you generally cannot recover. Below that, your recovery is reduced by your share of fault.
- PIP pays first in most car crashes. Your own Personal Injury Protection covers up to $10,000 in medical bills and lost wages, if you get treatment within 14 days.
- Government claims are different. If a city bus, county vehicle or dangerous public road played a role, written notice must be given to the government before suing.
Getting Help After a Crash in Hialeah
Crashes in Hialeah are usually handled by the Hialeah Police Department. Crashes on state highways may be handled by the Florida Highway Patrol. You can request a copy of your crash report once it is filed, and we can get it for you.
For serious injuries, the nearest trauma care is often the Ryder Trauma Center at Jackson Memorial Hospital. Keep every record from the ambulance, emergency room and follow-up visits. Those records are the backbone of your claim.
Injuries We Often See
- Neck and back injuries, including herniated discs
- Broken bones and fractures
- Concussions and traumatic brain injuries
- Spinal cord injuries
- Knee and shoulder injuries that need surgery
- Burns, scarring and disfigurement
Some injuries, like concussions and disc injuries, do not show up right away. Get checked by a doctor even if you feel fine after a crash.
What Your Claim Can Include
Florida law lets injured people recover for the full impact of an injury caused by someone else’s negligence. Depending on your case, that can include:
- Medical bills, past and future, including surgery, therapy and medication
- Lost wages and lost ability to earn in the future
- Pain, suffering and emotional distress
- Loss of enjoyment of life, including activities you can no longer do
- Property damage, such as vehicle repair or replacement
- For families, wrongful death damages when a loved one is killed
We document every loss with medical records, bills, employer records and, when needed, expert opinions, so the insurance company cannot overlook any part of your claim.
