Roads and places on Key Biscayne
Key Biscayne is a barrier island east of Miami, between Biscayne Bay and the Atlantic Ocean. The Village of Key Biscayne, incorporated in 1991, sits in the middle of the island. Crandon Park lies to the north, and Bill Baggs Cape Florida State Park, home of the Cape Florida Light, covers the southern end.
The Rickenbacker Causeway links Miami to Virginia Key and Key Biscayne. Miami-Dade County owns and operates it, and a toll is charged on the way out to the islands. The causeway and Crandon Boulevard are part of a popular cycling route, so drivers share the road with large numbers of riders, especially on weekends. Crandon Boulevard runs from the end of the causeway through Crandon Park and the village to the state park. The speed limit on Crandon Boulevard in the village is 30 mph.
Crandon Park has a long Atlantic beach, a marina, a golf course and a tennis center. Bill Baggs has more than a mile of beach, a seawall used for fishing, and No Name Harbor, a natural anchorage. These places draw crowds of visitors, and so do the island’s hotels and condos.
The Village of Key Biscayne has its own police department, which handles crashes and incidents in the village. Crashes on the causeway or in the parks outside the village may be handled by another agency, depending on where they happen. Our guide to the Miami-Dade crash report explains how to get a copy.
Bicycle crashes on the Rickenbacker Causeway
Cyclists ride the causeway and Crandon Boulevard early in the morning and on weekends. A driver who drifts into the bike lane, passes too closely, opens a door, or turns across a rider’s path can cause life-changing injuries. Riders can also be hurt by debris or broken pavement.
A cyclist hit by a car can often turn to PIP the same way a pedestrian can: your own policy first, then a resident relative’s policy, and if neither exists, the PIP of the vehicle that hit you. If the driver fled, report it to police right away, because your uninsured motorist coverage may help. If you were riding an e-bike or scooter, see our e-bike and scooter accident page.
Car accidents on the causeway and Crandon Boulevard
Beach traffic, rideshare pickups, drivers looking for parking, and sudden stops on the causeway bridges can all lead to crashes. Some drivers leave a beach day or a restaurant after drinking. A driver who causes a crash while impaired can face punitive damages. See our drunk driver accident page.
Florida is a no-fault state. Your own personal injury protection (PIP) pays first, up to $10,000, no matter who caused the crash. It covers 80% of medical bills and 60% of lost wages. You must get medical care within 14 days. Without an emergency medical condition finding, PIP medical benefits are limited to $2,500. Florida does not require most drivers to carry bodily injury coverage, so the at-fault driver may have little or none. Our Miami car accident lawyer page explains more.
Golf cart accidents in the village
Golf carts are a common way to get around the village. The Village Police require carts to be registered and inspected each year, and drivers need a valid license and golf cart insurance. Carts are not allowed on Crandon Boulevard except to cross it or reach the next street. They are also barred from the beach, parks, bike paths and sidewalks, and must have headlights and a windshield to be driven after dark.
A golf cart gives riders little protection in a crash with a car. Children and passengers can be thrown from a cart in a sharp turn or a collision. Who pays depends on the vehicles, the insurance and the facts. See our Miami golf cart accident lawyer page.
Boating and jet ski accidents
Boats, jet skis, kayaks and paddleboards share the waters around Key Biscayne and Biscayne Bay. Careless or impaired operators, rental companies that skip safety instructions, and crowded anchorages can all lead to injuries.
In Florida, operators born on or after January 1, 1988 need a boating safety ID card to run a vessel of 10 horsepower or more, and the boating under the influence limit is 0.08. Serious boating accidents must be reported to the Florida Fish and Wildlife Conservation Commission or local law enforcement. Federal maritime law can apply and can change the rules and deadlines. See our Miami boat accident lawyer page.
Hotel, condo and pool injuries
Hotels and condo buildings must keep pools, decks, stairs and walkways reasonably safe. Wet pool decks, broken tiles, poor lighting, missing pool gates and broken railings can cause falls and other serious injuries. Under Florida law, if you slip on a spill or other substance in a business, you must show the business knew about it or should have known. Report the injury to management, ask for a copy of the report and take photos. See our Miami slip and fall lawyer page.
Visitors from out of state who are hurt here can still bring a claim in Florida. We work with clients by phone and video after they go home.

Florida law you should know
Most negligence claims from injuries on or after March 24, 2023 must be filed within 2 years, and a wrongful death claim must be filed within 2 years of the death. Claims against a government agency, such as a town, the county or a transit agency, require written notice first and have damage caps. Florida uses modified comparative negligence: if you are found more than 50% at fault, you generally recover nothing, and if you are 50% or less at fault, your recovery is reduced by your share. In a hypothetical case where you are found 20% at fault, your recovery would be reduced by 20%.

Lawsuits are filed in the county where the case belongs, and cases from Key Biscayne are usually filed in Miami-Dade County. Mike Redondo is licensed throughout Florida, and Mike personally oversees every case. Before founding Redondo Law in 2019, he spent six years at Holland & Knight defending major corporations in catastrophic injury and wrongful death cases, so he knows how hotels, property owners and other corporate defendants build a defense. When an accident takes a life, we also help families with wrongful death claims. We also serve clients in Miami Beach.
Frequently asked questions
Do you have an office on Key Biscayne?
No. Our only office is at 2828 Coral Way in Miami. Clients on Key Biscayne meet with us by phone, by video or at that office. If you cannot travel because of your injuries, we come to you.
I was hit by a car while cycling on the Rickenbacker Causeway. What should I do?
Get medical care right away and keep every record. Ask for the police report number and take photos of your bike, your gear and the scene. PIP may pay some medical bills first. If the driver had little or no insurance, or fled, your uninsured motorist coverage may help. Call us before you talk to the driver’s insurer.
Can I make a claim if I was hurt in a golf cart crash?
Possibly. If another driver, the cart’s operator, or a faulty cart caused the crash, you may have a claim. The village requires registered carts to carry golf cart insurance, and the other driver’s policy or your own policies may also apply. We review every policy that might cover you.
I was visiting and got hurt at a hotel pool. Can I still file a claim after I go home?
Yes. A claim for an injury on Key Biscayne is usually brought in Florida, even if you live somewhere else. We can work with you by phone and video. Report the injury to the hotel before you leave and keep copies of any reports, photos and medical records.
How much does it cost to hire you?
The consultation is free, and there is no fee unless we win. Florida Bar rules limit contingency fees, and you will receive and sign a Statement of Client’s Rights before we begin.
