Where injuries happen in Miami Gardens
Miami Gardens sits in northern Miami-Dade County, next to the Broward County line. Some of the busiest highways in South Florida run through or beside it. Florida’s Turnpike crosses the city and has an exit at NW 199th Street for Hard Rock Stadium. The Palmetto Expressway (SR 826) and I-95 meet the Turnpike and US-441 at the Golden Glades Interchange, which sits in Miami Gardens and North Miami Beach.
Local roads carry heavy traffic too. Miami Gardens Drive, also known as NW 183rd Street (SR 860), runs east and west across the city. NW 27th Avenue runs north toward the stadium area. US-441 (NW 2nd Avenue / State Road 7) carries cars, trucks and buses through the eastern side of the city. Students and staff travel to and from St. Thomas University and Florida Memorial University, both in Miami Gardens. For more on major roads across the county, read our guide to dangerous roads in Miami-Dade.
Miami Gardens has had its own police department since 2007, and the Miami Gardens Police Department handles most crashes and incidents on city streets. Crashes on the Turnpike, the Palmetto and I-95 are usually handled by the Florida Highway Patrol. Cases from Miami Gardens are filed in Miami-Dade County, which is part of Florida’s 11th Judicial Circuit. To learn how to get your report, see our guide to the Miami-Dade crash report.
Car accidents in Miami Gardens
Rear-end, side-impact and lane-change crashes near the Golden Glades and on busy local roads can all cause serious injuries. Afternoon rainstorms and heavy event traffic add more risk.
Florida is a no-fault state. Your own personal injury protection (PIP) coverage pays first, no matter who caused the crash. PIP pays up to $10,000: 80% of medical bills and 60% of lost wages. You must get medical care within 14 days. Without an emergency medical condition finding, PIP medical benefits are limited to $2,500. If your injuries are serious and permanent, you may also have a claim against the at-fault driver. Learn more on our Miami car accident lawyer page.
Florida does not require most drivers to carry bodily injury coverage. That means the driver who hit you may have little or none. Your own uninsured motorist (UM) coverage can fill that gap. Read how it works on our uninsured motorist page.
Truck crashes on the Turnpike and the Palmetto
Tractor-trailers and delivery vans use the Turnpike, the Palmetto and I-95 every day. A crash with a large truck can cause far worse injuries than a crash between two cars.
Truck cases often involve more than one party. The driver, the motor carrier, the truck owner, the company that loaded the cargo and the company that maintained the truck may all share the blame. Federal rules limit drivers to 11 hours of driving within a 14-hour window after 10 hours off duty, and electronic logging devices record those hours. That data can be lost if no one asks for it early. See our Miami truck accident lawyer page.
Pedestrian and bus accidents
Many people in Miami Gardens walk to bus stops, schools, stores and work. Wide, fast roads like Miami Gardens Drive, NW 27th Avenue and US-441 can be hard to cross on foot. Drivers turning at intersections or pulling out of shopping center lots may not see a person walking.
If you were hit while walking, PIP usually still applies. Your own PIP pays first. If you have none, a resident relative’s policy may apply. If neither exists, the PIP of the vehicle that hit you may apply. If the driver fled, report it to police right away, because UM coverage may help. See our Miami pedestrian accident lawyer page.
Riders and people near bus stops can also be hurt in crashes involving public or private buses. A claim against a government transit agency requires written notice first and has damage caps. Our bus accident page explains more.
Stadium and event injuries at Hard Rock Stadium
Hard Rock Stadium is home to the Miami Dolphins and the University of Miami Hurricanes football team. It also hosts the Orange Bowl, the Miami Open tennis tournament, the Formula 1 Miami Grand Prix, and large concerts. These events bring huge crowds to Miami Gardens.
People can be hurt by falls on stairs and wet walkways, crowd surges at gates and exits, or assaults in parking lots. Venue owners and event operators must keep their property reasonably safe and take reasonable steps against crime they can foresee. Whether anyone is responsible depends on the facts of each case.
If you were hurt at an event, report it to staff, get an incident report and take photos. Event video may not be kept long. These can be slip and fall or negligent security claims.
Negligent security at apartment complexes
Broken gates, dark parking lots, broken locks and missing cameras can all play a role in assaults, robberies and shootings at apartment complexes.
These cases changed in 2023. Juries can now assign fault to the attacker as well as the property owner. Owners of multifamily housing can also get a presumption against liability if they meet specific security measures, such as cameras, lighting, deadbolts, locks, peepholes, a crime-prevention assessment and employee training. That makes early investigation important. See our Miami negligent security lawyer page.
Slip and falls in stores and shopping centers
Spilled liquids, wet floors after rainstorms, loose mats and broken parking lot pavement at Miami Gardens stores can cause a bad fall and broken hips, wrist fractures and back injuries.
Florida law sets a specific rule for falls caused by a spill or other substance on a business floor. You must show the business knew about it or should have known. For example, the spill was there long enough that staff should have found it, or the same problem kept happening. Read more on our Miami slip and fall lawyer page.
What to do after an injury in Miami Gardens
- Call 911. Ask for the Miami Gardens Police on city streets, or the Florida Highway Patrol on the Turnpike, the Palmetto or I-95.
- Get medical care right away. For PIP, you must be seen within 14 days of a crash.
- Take photos of the scene, the vehicles or hazard, and your injuries.
- Get names and phone numbers of witnesses.
- At a stadium, store or apartment complex, report the incident to staff or management and ask for a copy of the report.
- Note any cameras nearby. Video is often erased within days or weeks.
- Do not give a recorded statement to the other side’s insurer.
- Call us before you sign anything from an insurance company.
Florida law you should know
Most negligence claims from injuries on or after March 24, 2023 must be filed within 2 years, and a wrongful death claim must be filed within 2 years of the death. Claims against a government agency, such as a city or county, require written notice first and have damage caps. Florida uses modified comparative negligence: if you are found more than 50% at fault, you generally recover nothing, and if you are 50% or less at fault, your recovery is reduced by your share. In a hypothetical case where you are found 20% at fault, your recovery would be reduced by 20%.
How working with a Miami-based firm works
We do not have an office in Miami Gardens. Our only office is at 2828 Coral Way in Miami. You can meet with us by phone, by video or in person at the Miami office. If your injuries keep you from traveling, we come to you.
Mike personally oversees every case, and he is licensed throughout Florida. Before founding Redondo Law in 2019, he spent six years at Holland & Knight defending major corporations in catastrophic injury and wrongful death cases, so he knows how corporate defendants build a defense. We explain each step in plain terms, in English or Spanish. When a loved one dies, we also help families with wrongful death claims.
Frequently asked questions
Do you have an office in Miami Gardens?
No. Our only office is at 2828 Coral Way in Miami. Clients in Miami Gardens meet with us by phone, by video or at that office. If you cannot travel because of your injuries, we come to you.
I was hurt at a game or concert at Hard Rock Stadium. Do I have a claim?
Maybe. It depends on what caused the injury. A fall on a hazard the venue should have fixed, or an assault the venue could have foreseen and did not take reasonable steps to prevent, may support a claim. Report it to staff, get an incident report, take photos and call us early so we can ask for video before it is lost.
Who investigates a crash in Miami Gardens?
The Miami Gardens Police Department handles most crashes on city streets. The Florida Highway Patrol usually handles crashes on the Turnpike, the Palmetto Expressway and I-95. Ask for the report number at the scene.
I was robbed or attacked at my apartment complex. Can I sue the owner?
You may have a negligent security claim if the owner failed to take reasonable steps against crime it could foresee, such as fixing broken gates, locks or lights. Since 2023, juries can assign fault to the attacker too, and some owners get a presumption against liability if they meet specific security measures. We look at the facts and tell you where you stand.
How much does it cost to hire you?
The consultation is free, and there is no fee unless we win. Florida Bar rules limit contingency fees, and you will receive and sign a Statement of Client’s Rights before we begin.
