Westchester is a busy residential and commercial area in west Miami-Dade, home to Florida International University, Tropical Park and some of the most congested roads in the county. Commuters cut through on their way to the Palmetto Expressway, and heavy traffic on Bird Road and Coral Way keeps crash rates high.
Redondo Law’s office is on Coral Way, a straight shot east from Westchester. Mike Redondo personally oversees every case, and our team is fully bilingual.

Florida Law You Should Know
- Two-year deadline. For most negligence claims arising on or after March 24, 2023, you have two years to file a lawsuit.
- Modified comparative fault. If you are found more than 50% at fault, you generally cannot recover. Below that, your recovery is reduced by your share of fault.
- PIP pays first in most car crashes. Your own Personal Injury Protection covers up to $10,000 in medical bills and lost wages, if you get treatment within 14 days.
- Government claims are different. If a city bus, county vehicle or dangerous public road played a role, written notice must be given to the government before suing.
Getting Help After a Crash in Westchester
Crashes in Westchester are usually handled by the Miami-Dade Sheriff’s Office, since Westchester is unincorporated. Crashes on state highways may be handled by the Florida Highway Patrol. You can request a copy of your crash report once it is filed, and we can get it for you.
For serious injuries, the nearest trauma care is often the Ryder Trauma Center at Jackson Memorial Hospital, though many patients are first seen at Kendall Regional Medical Center or Coral Gables Hospital. Keep every record from the ambulance, emergency room and follow-up visits. Those records are the backbone of your claim.
Injuries We Often See
- Neck and back injuries, including herniated discs
- Broken bones and fractures
- Concussions and traumatic brain injuries
- Spinal cord injuries
- Knee and shoulder injuries that need surgery
- Burns, scarring and disfigurement
Some injuries, like concussions and disc injuries, do not show up right away. Get checked by a doctor even if you feel fine after a crash.
What Your Claim Can Include
Florida law lets injured people recover for the full impact of an injury caused by someone else’s negligence. Depending on your case, that can include:
- Medical bills, past and future, including surgery, therapy and medication
- Lost wages and lost ability to earn in the future
- Pain, suffering and emotional distress
- Loss of enjoyment of life, including activities you can no longer do
- Property damage, such as vehicle repair or replacement
- For families, wrongful death damages when a loved one is killed
We document every loss with medical records, bills, employer records and, when needed, expert opinions, so the insurance company cannot overlook any part of your claim.
What to Do After an Accident in Westchester
- Call 911 and ask for a police report. Write down the report number.
- Take photos of the scene, the vehicles, any hazard and your injuries.
- Get names and phone numbers of witnesses.
- If the crash was on the Palmetto, note the nearest exit or mile marker.
- See a doctor right away, and within 14 days for a car crash to protect your PIP benefits.
- Do not give a recorded statement to an insurance company before talking to a lawyer.
Where Your Case Will Be Filed
Injury lawsuits arising in Westchester are generally filed in the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County.

Frequently Asked Questions
I am an FIU student hurt near campus. Do I have a case?
Possibly. Students hit by cars or hurt on unsafe property have the same rights as anyone else. If a family member’s auto policy covers you, PIP may pay first.
What if the driver who hit me fled?
Report it to police right away. Your own uninsured motorist coverage may pay. Nearby cameras can help identify the driver, but footage disappears fast.
How long do I have to file?
For most negligence claims arising on or after March 24, 2023, two years. Do not wait.
